When granting a subsidy to private organisations, the government providing the subsidy must take into account the European regulations on state aid. For there is a risk that a proposed subsidy may qualify as unauthorised state aid.
Our lawyers advise governments about the state aid problems and help them find ways to shape the envisaged subsidy so as to be compatible with the rules on state aid. We advise both governments and businesses, for example, on the interpretation of the regulations under the Dutch General Administrative Law Act, the problems of capital formation for the subsidy recipient, and termination of subsidy relationships.
